According to the Mercury News, "the victim called police again, saying Smith bit her wrists and climbed out her window, possibly fleeing in a black Range Rover, according to dispatch audio reviewed by this news agency".

Smith was detained for public intoxication previous year after a auto crash with an unmarked police vehicle. He voluntarily entered rehab and missed five games that season.

The troubled linebacker has been arrested several times on charges of drunken driving, vandalism and illegal possession of assault rifles among other charges since the San Francisco 49ers drafted him in 2011 in the first round. A San Francisco dispatcher reportedly said that Smith drank two bottles of tequila. Smith has yet to be reinstated by the league, and is expected to by released by the Raiders following this latest incident.

Smith hasn't played a snap since 2015 and was already now banned from the NFL due to his status as a repeat offender of the league's substance abuse program.
